Terms of service

We summarise our Sale Terms below:

  • Brands covered: These Sale Terms apply to the sale of ShedRain products and any other brands or product ranges identified on our website as being sold by ShedRain UK. You may wish to print or save a copy of these Sale Terms for your records.
  • Where to find information about us and our products: You can find key information about ShedRain UK and our products on our website before you order. We will also confirm key order information to you in writing, usually by email or in your online account, before or after you place your order.
  • Orders: The contract is formed when we contact you to confirm your order has been dispatched. Placing the order and arranging payment does not create the contract. Your offer to buy is accepted by us when we dispatch the order to you.
  • Please note: When you buy from us, you are agreeing that we may check and accept or reject orders, products may vary slightly from their pictures, delivery dates are estimates, and you have cancellation, returns and faulty goods rights.
  • Your data. We will use your personal data as set out in our Privacy Notice at www.shedrain.co.uk/policies/privacy-policy. This includes information you provide when using our website, creating an account, placing an order, contacting us, or otherwise interacting with us.
  • Umbrella Lifetime Warranty: Some ShedRain products may also benefit from a ShedRain lifetime warranty. This is separate from, and in addition to, your statutory consumer rights. The warranty does not apply to all products sold on our website, such as clothing, rainwear or other accessories, and the detailed warranty terms are set out below at section 7.2.

2. ABOUT THESE TERMS (AND HOW THEY MAY CHANGE)

2.1 These Sale Terms have been prepared for consumers and give legal rights that can't be limited or removed. The Sale Terms explain:

2.1.1 how orders are placed and accepted;

2.1.2 delivery;

2.1.3 cancellations and returns;

2.1.4 what happens if something goes wrong.

2.2 If we change these Sale Terms:

2.2.1 any changes will be published on our website with the "Last updated" date;

2.2.2 changes will have immediate effect but won't affect existing orders;

2.2.3 if you keep using our website after we make any changes, this means you accept those changes;

2.2.4 your order will be governed by the Sale Terms in force when you placed it, unless a change is required by law.

3. ORDERING ON OUR WEBSITE

3.1 When you place an order on our website, it will be subject to our acceptance under these Sale Terms.

3.2 You will have an opportunity to check and correct any input errors in your order up until the point at which you submit your order by confirming your payment on the checkout page. No amendments can be made by you to your order after this point.

3.3 After you place an order on the website, we will send an acknowledgement email or SMS confirming that we have received it. This acknowledgement is not our acceptance of the order.

3.4 If we cannot accept an order, we will notify you and refund payment taken for the applicable item(s), including any delivery charges if we cannot accept any part of your order. Examples where we cannot accept an order include:

3.4.1 the item is out of stock;

3.4.2 payment cannot be authorised;

3.4.3 there is a pricing error (see Section 5.4);

3.4.4 we reasonably suspect fraud or misuse;

3.4.5 our products are for personal use only. We may decline orders that appear to be for business or resale purposes, including orders placed through shipping or forwarding agents, where the volume of orders is not consistent with personal use or we detect a volume or pattern of orders which suggests that you are offering our products for resale.

4. TITLE (OWNERSHIP) AND RESPONSIBILITY (RISK)

4.1 Ownership of products passes to you only when we have received payment in full and the goods have been delivered.

4.2 Once the products are delivered to your address, or left with someone or somewhere you have chosen, they become your responsibility.

5. PRICES, PAYMENT AND PRICING ERRORS

5.1 Prices are shown in pounds sterling and include VAT where applicable. Delivery charges, if any, are shown clearly before you pay. All unavoidable fees will be included or clearly disclosed upfront. Prices are subject to change, but such changes won't affect orders already placed, unless there's an error – see Section 5.4.

5.2 If the rate of VAT changes between the date of your order and the date we supply the product, we may adjust the VAT you pay, unless you have already paid in full before the VAT change takes effect.

5.3 Unless stated otherwise for a particular payment method, we take payment when you place your order (after we've checked for availability and authorisation of your payment card).

5.4 If we discover a pricing error before dispatch, we will contact you and give you the option to:

5.4.1 proceed at the correct price, or

5.4.2 cancel for a full refund.

5.5 If we can't reach you within a reasonable period, we won't be able to accept your order, and we'll issue a refund.

5.6 We may carry out reasonable checks to help protect customers and ShedRain from fraud and misuse of our website. This may include checking the information you provide when placing an order. Please note:

5.6.1 these checks are carried out only where we consider them reasonably necessary;

5.6.2 we may use trusted third-party service providers to help us carry out those checks;

5.6.3 the checks are not a credit application and will not affect your credit rating;

5.6.4 we will handle your personal information securely and in line with our Privacy Notice and applicable data protection laws.

6. DELIVERY

6.1 Delivery is available to mainland UK and Northern Ireland. Other areas may have restrictions depending on the item and delivery method. Any restrictions will be shown during checkout.

6.2 Delivery dates and times shown at checkout are estimates. We will aim to deliver within those estimated timescales. However, delays may occur due to unforeseen reasons. Delivery charges and delivery guidance will be shown during checkout.

6.3 For proof of delivery, our drivers or delivery partners may request a signature or take a delivery photograph. Photographs are used only for delivery evidence and handled in line with our Privacy Notice at www.shedrain.co.uk/policies/privacy-policy.

6.4 If no one is available. If a delivery requires someone to be present and no one is available, we may need to rearrange delivery and may charge a reasonable redelivery fee. We will inform you of this before any redelivery fee is charged, and the fee will reflect our actual additional cost.

6.5 If delivery is late (your legal rights).

6.5.1 If we do not deliver the goods by the estimated delivery date, you may require us to deliver within a further reasonable period. If we have said that we will not deliver the goods, or if delivery within the agreed period was essential and this was made clear to us, you may be entitled to end the contract and receive a refund for any goods not delivered, including the delivery charge if the entire order is not delivered.

6.5.2 We are not responsible for delays outside our control. If our supply of a product is delayed by an event outside our control, we will contact you as soon as possible to let you know and will take reasonable steps to reduce the delay. If the delay is likely to be substantial, you may contact us to end the contract and receive a refund for any products you have paid for but not received.

7. RETURNS, CANCELLATIONS AND REFUNDS

7.1 Summary — this Section 7 covers:

7.1.1 the ShedRain lifetime warranty;

7.1.2 your statutory right to cancel online orders within 14 days; and

7.1.3 your legal remedies if goods are faulty or damaged.

7.2 ShedRain Lifetime Warranty

7.2.1 The ShedRain business has offered umbrella protection for many years. If a ShedRain umbrella fails because of defects in materials or workmanship, we will assess the claim and, where the claim is valid, provide a replacement umbrella. This warranty is offered in addition to your statutory rights and does not limit or replace them.

7.2.2 The lifetime warranty applies only to ShedRain umbrellas purchased from us or an authorised retailer. It does not apply to other items sold on the website, including clothing, rainwear, masks or other accessories.

7.2.3 The warranty applies only where the umbrella has been used under normal conditions and for the purpose for which it was designed. It does not apply to normal wear and tear, misuse, alteration, accident, improper care, loss or theft.

7.2.4 If we no longer make the style, colour or print of your umbrella, we will do what we reasonably can to provide a replacement that is as close as possible in size, function and colour or print. Customised or printed umbrellas will not be replaced with the same custom print.

7.2.5 Warranty claims are assessed on a case-by-case basis. We will act in good faith when assessing whether a claim is valid, but the warranty is not automatic and may be refused where the conditions above are not met. We have discretion, which we will exercise fairly.

7.2.6 The lifetime warranty applies to the original purchase only. If we honour the warranty and provide a replacement umbrella, the lifetime warranty will not apply to that replacement umbrella. If the replacement umbrella is faulty, you will still have the consumer rights available to you under the Consumer Rights Act 2015.

7.2.7 Please allow approximately 2 to 3 weeks for warranty processing.

7.2.8 Warranty claims must be submitted using our warranty claim process at www.shedrain.co.uk/pages/warranty. Please include all information we reasonably require, including proof of purchase, so that we can assess and process your claim.

7.3 Statutory right to cancel

7.3.1 You have the statutory right to cancel your order for any reason within 14 days beginning with the day after you (or your nominee) receive the item. These rights are based on the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

7.3.2 To exercise your statutory right to cancel, you must tell us clearly that you wish to cancel. You must return the goods within 14 days of telling us that you have changed your mind. Unless our Returns Policy says otherwise, you are responsible for the cost of returning the goods.

7.3.3 If you cancel under your statutory cancellation right, we will refund the price paid for the goods and the standard delivery charge you paid for delivery to you. We do not refund any extra amount paid for premium, express or nominated-day delivery. We will refund you using the same payment method you used for the order and will not charge a refund fee.

7.3.4 We may reduce your refund if you have handled the goods more than would be permitted in a shop and this has reduced their value, for example if the goods are worn, damaged, missing tags or returned without original packaging or accessories where these are needed for resale.

7.3.5 If your order contains multiple products delivered on different days, the 14-day period runs from the day after the last item arrives.

7.4 If your product is faulty

7.4.1 If goods are not of satisfactory quality, fit for purpose, as described, or otherwise do not conform to the contract (i.e. they are "faulty"), you are entitled to legal remedies. These rights are based on the Consumer Rights Act 2015 and may include repair, replacement or refund.

7.4.2 In summary, the Consumer Rights Act 2015 says that goods must be as described, fit for purpose and of satisfactory quality. If your goods are faulty, you may be entitled to reject them for a refund within 30 days. If a fault appears within six months, you may be entitled to repair or replacement and, if that is not possible or does not resolve the issue, a refund. You may also have rights for up to six years if goods do not last a reasonable length of time, depending on the circumstances.

8. PRODUCT INFORMATION

8.1 We aim to make sure that product descriptions, images and specifications on our website are accurate. Please note that:

8.1.1 packaging may differ from the images shown;

8.1.2 weights, dimensions and capacities are approximate;

8.1.3 you are responsible for checking that any size, fit, colour, style or measurement information you select is suitable before placing your order;

8.1.4 colours may look different depending on your device or screen settings;

8.1.5 all items are subject to availability. If something you order is unavailable, we will let you know as soon as possible; and

8.1.6 we may withdraw or discontinue products from sale. If this affects an order you have already placed, we will let you know and refund any amounts you have paid for products we cannot supply.

9. OUR RESPONSIBILITY TO YOU

9.1 We have a legal duty to supply products that conform with the contract. Nothing in these Sale Terms limits our liability for goods failing to conform where the Consumer Rights Act 2015 requires a remedy. However, we are unable to accept liability for any loss that is not reasonably foreseeable, nor for any business-related losses, including loss of profits, contracts, goodwill, opportunities or similar losses.

9.2 You must follow any instructions or guidance provided on the website to ensure the products are used and stored safely, including any information set out in product manuals or accompanying materials. We will not be liable for any damage to the products resulting from your failure to follow this guidance.

9.3 Your purchase will be transacted through our website. While we aim to keep our website available and secure, please note the following points, which are supplemental to the Terms and Conditions.

9.3.1 We can't guarantee that the website will always be available, free from errors, or free from viruses or bugs.

9.3.2 We can't guarantee that any issues will be corrected, or that all content on the website will always be accurate, reliable, or fully functional.

9.3.3 We aren't responsible for any loss of information or material you upload to, or send through, the website.

9.3.4 We aren't liable for any loss or damage that results from actions taken (or not taken) based on information on the website.

9.3.5 In addition, we use reasonable security measures to protect your order and payment details. Unfortunately, no system can be completely secure. We won't be responsible for losses caused by unauthorised access to your information where this occurs despite us taking reasonable care, and we have not breached our legal obligations.

9.4 No exclusion of your consumer rights

9.4.1 Nothing in these Sale Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability which may not otherwise be limited or excluded under law.

9.4.2 In addition, nothing in these Sale Terms affects your legal rights in relation to faulty goods, late delivery, cancellations or refunds. This is explained in more detail in Section 7.

9.4.3 Nothing in these Sale Terms affects your statutory rights. Where goods do not conform with the contract, you will be entitled to the remedies available under the Consumer Rights Act 2015, and nothing in these Sale Terms excludes or limits our liability to provide those remedies.

10. COMPLAINTS AND DISPUTE RESOLUTION

10.1 If you have a complaint, please contact Customer Services at www.shedrain.co.uk/pages/contact-us. We will work with you to resolve any issues promptly and fairly.

10.2 If we cannot resolve your complaint directly, we will let you know whether we are willing to use an alternative dispute resolution process. Alternative dispute resolution is a process where an independent body considers the facts of a dispute and seeks to resolve it without the need to go to court. This does not affect your right to bring a claim in court.

11. OTHER IMPORTANT TERMS

11.1 These Sale Terms are governed by the laws of England and Wales. The courts of England and Wales will have jurisdiction. Customers who live in Scotland or Northern Ireland can also bring claims against ShedRain in the courts of the country they live in.

11.2 If a court finds part of these Sale Terms unlawful, we will remove or adjust only that part. Everything else will continue to apply as normal.

11.3 Except as stated, no one else has rights under these Sale Terms under the Contracts (Rights of Third Parties) Act 1999.

11.4 We may transfer our rights and obligations under these Sale Terms to another organisation, provided this does not affect your rights under these Sale Terms or your legal rights as a consumer.

11.5 If we delay in enforcing any right under these Sale Terms, that does not mean we have given up that right or that we cannot enforce it later.
